License Agreement for QuickLaunch (the „Software“) Date: February 2004 Attention: Please read this text carefully. To use the software, you must agree to all terms of this license agreement. If you („the user“) cannot agree with the terms of contract, you must not use the software and are obliged to destroy all copies of the software in your property. This also applies if you discover objections against the terms of condition during the use of the software. In this case, you must stop using the software immediately. Author and Copyright „Author“ of the software is Oliver Frietsch, Dürerstraße 1, 53340 Meckenheim, Germany. All copyrights and rights of intellectual property concerning the software and its documentation - if available - remain in the author. Special Appointments The author can grant particular users special rights regarding the software or approve offenses against this license agreement. In this case, the author drafts a manually signed document detailly describing the user's additional rights and tolerated offenses against the license agreement. To be valid, this document must be delivered to the user via postal service or fax. The user is obliged to keep the document safely and present it upon request. Distribution Model The software is distributed as freeware; this means it may be used free of charge for commercial and non-commercial purposes in conjunction with the terms of this license agreement. User's Rights and Duties The author grants the user non-exclusive rights to - install and use the software on any number of computers - make the software available to third-parties via networking systems or any other ways, provided that all other users also agree to all terms of this license agreement - archive the software for backup or other purposes, provided that a copy of this agreement is archived together with the software - lend the software to third-parties without charge - offer the software on web sites, online download archives etc., provided that the web site also offers a link to the author's web site at http://www.oliver-frietsch.de The user admits he/she has no claim, neither of further development of the software nor of technical support by the author or third-parties. The user must not - permit third-parties using the software in contradiction to this license agreement - grant third-parties any rights regarding the software not explicitely listed in this license agreement - change, disassemble or decompile the software and/or its documentation - if available; reverse engineering is also strictly forbidden - remove copyright or other notices or make other changes veiling the original author of the software - offer the software as part of his/her own software - rent the software for money - sell the software - offer the software on compact discs or other media (magazine cds, software collections etc.) without the author's explicit, written permission - use the software in environments where human lives or critical systems depend on error-free operation of the software or the use of the software is an immediate danger („high risk activities“). Especially, the software must not be used in arms industries and army or nuclear facilities. Disclaimer The software is provided on an „as is“ basis without warranties of any kind. The whole responsibility and risk resulting from the use of the software is borne by the user. Under no circumstances shall the author be liable to the user or third-parties for any direct or indirect damages resulting from the use of the software, including but not limited to loss of profit, loss of reputation or downtimes, even if the author was informed about the possibility of damages. The user is obliged to secure the integrity and completeness of important data by making regular data backups. Replacement Terms Should one of the terms of this license agreement be invalid because of local law, it shall be replaced by a locally valid term that is closest to the original meaning.
